SMS Terms

1. The program
Mutagenic Labs, LLC ("Mutagenic") sends text messages from its own phone numbers in connection with its websites, products and services. Messages include replies to your texts, a text back when we miss your call, scheduling and confirmation messages, account and service notices, support, and responses to questions about our products, including calls to our product demonstration lines.
We send marketing or promotional texts only to people who have separately and expressly agreed to receive them.
2. How you opt in
You opt in by texting one of our numbers, by calling one of our numbers and agreeing to receive a text, by checking a text-message consent box on one of our forms or in one of our products, or by asking us in writing to text you. Your first message from us confirms the program name, how often to expect messages, and how to opt out.
3. Eligibility
You must be at least 18 years old, and the account holder for the mobile number you use or have the account holder's permission.
4. Frequency and cost
Message frequency varies with your conversation or account activity. Message and data rates may apply, depending on your mobile plan.
5. Opting out and getting help
Reply STOP (or CANCEL, END, QUIT, UNSUBSCRIBE or STOP ALL) to any message to stop receiving texts from that number. We will send one message confirming that you have opted out and will send no more unless you opt in again. Reply HELP for help, or email hello@mutagenic.io.
6. Businesses using our services
If you texted or called a business that uses our services, messages come from that business, under its name and its own terms, and that business is responsible for them. STOP and HELP work the same way on those numbers.
7. Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, device and coverage, and we do not guarantee that any message will be delivered or received on time.
8. Privacy
We do not sell, rent or share mobile phone numbers, or text-message opt-in data and consent, with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how we handle personal information.
9. Disclaimer and limitation of liability
The text-message program is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. Texts are not a substitute for emergency services; if you have an emergency, call 911. The disclaimers and limitations of liability in our Terms of Use apply to this program.
10. Changes
We may change these terms or end the program. We will post changes here with a new effective date, and, where the law requires, we will notify you by text. Continuing to use the program after a change means you accept the updated terms.
11. Governing law and disputes
These terms are part of our Terms of Use. They are governed by California law, and disputes about them are resolved under the arbitration agreement in the Terms of Use.
